Transferring Guardianship of Student

Establishing Student Residency with a Family Living within the Wayne Central School District

To register a student who does not reside with his/her parents, or who resides with a non-custodial parent, the adult in the parental relationship needs to provide a signed affidavit indicating that they are the person(s) in parental relation to the child, over whom they have total and permanent custody and control and describing how they obtained custody and control whether through guardianship or otherwise.

The signed affidavit attests that the person in the parental relationship will do the following:

  • Assume all expenses for the student's well being (room, board, clothing, etc.)
  • Make total decisions regarding the student's education
  • Authorize and pay for medical treatment for the student
  • Provide necessary consents for the student
  • Claim the student on their Income Tax forms

Providing false information on the affidavit is a crime of perjury in the third degree (a class A misdemeanor). Additionally, intent to defraud the Wayne Central School District is a crime of perjury in the second degree (a class E felony). Should false information be discovered, the Wayne Central School District has the right to prosecute on criminal charges for providing false information.
